Swapot (Private) Limited (“Swapot,” “we,” “us,” or “our”) operates a managed marketplace for inspected pre-owned furniture in Lahore, Pakistan, accessible via swapot.com and any associated mobile properties (collectively, the “Platform”). Swapot acts as the principal data controller for personal data collected in connection with our services.

2. Information We Collect

We collect personal information directly from you, automatically through your interactions with our Platform, and via necessary transaction verification processes:

• Seller Information: Name, phone number, physical address, area, city, Computerised National Identity Card (CNIC) number (collected for verification and compliance under the Seller Agreement), listing details, and item photographs.
• Buyer Information: Name, phone number, email address, delivery address, and booking/order details.
• Signatures & Handover Records: Digital signatures drawn on-screen by sellers and Swapot personnel at the time of pickup as evidence of item handover. These are retained as image records linked to the transaction.
• Inspection & Condition Data: Photographs and technical assessment records obtained during item inspection, which form part of the permanent listing record.
• Chat & Communications Data: Information and messages transmitted through any chat or messaging tools made available on our Platform.
• Automatically Collected & Technical Data: Device & Log Data (IP address, operating system, browser type and version, unique device identifiers, time zone, and login details), Location Data (subject to device permissions, used to assist in pickup/delivery regions), and Clickstream Data (browsing patterns, pages visited, search queries, and visit duration).
• Payment Details: Payments are executed via bank transfer or Cash on Delivery (COD). Swapot does not collect or store online banking credentials or payment card details.

3. Age Limit and Minors (Pakistan Compliance)

Our services are intended for adult users. We do not knowingly collect personal information from individuals under 16 years of age.

In accordance with Pakistani law, if you are a resident of Pakistan and under 21 years of age, you may not contract with us directly. By using our Platform, you acknowledge that your legal guardian has reviewed and consented to this Privacy Policy on your behalf. Any consent required for processing your data must be granted by your legal guardian.

4. How We Use Your Information

We process personal data on the basis of contractual necessity, compliance with legal obligations, and our legitimate interests in operating a secure and efficient marketplace:

• Service Delivery: To schedule inspections, capture photographs, create listings, process bookings, compute delivery charges, and coordinate logistics.
• Platform Operations & Personalisation: To identify you upon login, map multiple devices used by you for a seamless experience, optimize search results, and improve user interface performance.
• Communications: To update you regarding active listings, bookings, or deliveries via WhatsApp, telephone, SMS, or account notifications.
• Financial Administration: To calculate and transfer seller proceeds, issue invoices, and maintain financial and tax records.
• Safety, Security & Fraud Prevention: To administer the Platform, conduct system testing, detect/prevent fraudulent transactions, and monitor internal communications against spam or abuse.
• Add-On Services: To connect you with third-party service providers (such as KaamKrew) when explicitly requested by you.

5. Communication and Marketing

We may send you essential transactional communications (e.g., booking confirmations, delivery status updates, account verification) via SMS, email, or in-app notifications. Because these are necessary to deliver our services, you cannot opt out of transactional messages.

Where permitted by law or based on your choices, we may send you marketing or promotional communications regarding our services. You may opt out of receiving promotional messages at any time by following the unsubscribe link in the message or contacting us directly.

6. Who We Share Information With

We do not sell personal information to third parties for marketing purposes. We share personal data only under the following conditions:

• Delivery & Field Logistics Personnel: Swapot logistics personnel assigned to a pickup or delivery receive contact details and address information required to perform their duties.
• Service Partners: Where you explicitly request an add-on service, relevant contact and delivery details are shared with our fulfillment partners (e.g., KaamKrew) after item delivery and payment completion.
• Technical Service Providers & Hosting: Cloud storage, hosting (e.g., AWS, Azure), and system maintenance providers operating under strict confidentiality and legal processing instructions.
• Analytics Providers: Aggregated or non-identifiable user activity data shared with tools (such as Google Analytics, Meta Pixel, Firebase, and Microsoft Clarity) to analyze traffic and site performance.
• Regulatory & Legal Authorities: Law enforcement agencies, regulators, courts, or governmental bodies where disclosure is required by law, regulation, or court order to defend legal rights or safety.
• Business Transfers: In the event of a merger, acquisition, or sale of company assets, user data may be transferred to the successor entity under terms equivalent to this Privacy Policy.

Swapot utilizes cookies, web beacons, and analytical software to store user preferences, manage sessions, and gather usage patterns. Upon expiry of the applicable retention period, data is deleted or anonymised.

In accordance with applicable law in Pakistan, you have the following rights regarding your personal data:

• Right of Access: The right to request access to and receive a copy of the personal information Swapot holds about you.
• Right to Rectification: The right to request correction of incomplete or inaccurate data held by us.
• Right to Withdraw Consent: The right to withdraw consent previously granted for specific data processing activities at any time (without affecting the lawfulness of processing carried out prior to withdrawal).
• Right to Request Erasure: The right to request deletion of your personal data, subject to statutory limits where continued retention is necessary for tax, regulatory, or legal defense purposes.
